Welcome to Paji Camera services!
To use Paji Camera, you shall read and comply with the Paji Camera User Agreement (the “Agreement”). This Agreement is a valid contract entered into between Shanghai Benqu Network Technology Co., Ltd. (“Benqu Technology” or “we”) and you in connection with your registration for and use of Paji Camera.
In order to better provide services to you, before using Paji Camera and/or related services, please carefully read and fully understand all terms, especially terms that exempt or limit our liability, restrict users’ rights, and stipulate dispute resolution methods and jurisdiction. Terms limiting or exempting liability or otherwise materially affecting your rights and interests may be highlighted in bold, underline or other forms. If you are a minor under the age of 18, you shall carefully read and agree to this Agreement under the supervision and guidance of, and with the consent of, your guardian before using “Paji Camera”.
Unless you have fully read and accepted all terms of this Agreement, you are not entitled to download, install or use Paji Camera and/or related services. Your clicking “Agree” or “Next”, downloading, installing, using, logging in, or otherwise using Paji Camera and/or related services shall be deemed that you have read and agreed to be bound by this Agreement. This Agreement shall take legal effect between you and Benqu Technology and become a legally binding document for both parties.
This Agreement applies to Paji Camera and/or related services provided by us, including but not limited to the currently launched photo shooting and beautification functions and services, as well as other services that may subsequently be included in the scope of services. Our existing services are available in the Paji Camera App, and the specific services shall be subject to those actually provided by us. Please note that some services in Paji Camera provided to you may be provided by other service providers, and we will prominently indicate the source of such services on the relevant interface.
Agreements on specific services (for example, the Paji Camera Privacy Policy), operating rules and explanations of specific matters published from time to time on Paji Camera pages shall constitute supplemental agreements to this Agreement and have the same effect as this Agreement. If any supplemental agreement is inconsistent with this Agreement, the supplemental agreement shall prevail; matters not agreed in the supplemental agreement shall be governed by this Agreement.
We have the right to adjust or change this Agreement, service rules and other content at any time, and will publish such updates by message push, web announcement or other means and notify you through in-app messages. If you continue to use our services after the content of this Agreement is updated, you shall be deemed to have fully read, understood and accepted the updated agreement; if you do not agree to the updated service terms, you shall immediately stop using the services.
We do not provide an account registration function. You may use Paji Camera’s basic functions and services for photo shooting and beauty effects without registration or login. To the extent permitted by law, you agree that we may use your Paji Camera service data and usage statistics. In the event of any dispute, you agree that Paji Camera’s system data shall prevail; we will take possible measures to ensure the authenticity of such data and adopt corresponding encryption and other security measures for data collection and storage in accordance with law.
You understand and agree to the following account use rules:
Your device ID is your unique identity identifier in the services. You shall be fully responsible for all operations and activities conducted under that device ID. If you discover any unauthorized activity involving your device ID, please notify us immediately. We will take timely measures to reduce your possible losses, such as assisting you to freeze the device ID or set other security measures; however, you understand and agree that it takes reasonable time for us to act on your request, and we shall not be liable for any losses you suffer as a result.
One device ID may correspond to only one entity. Unless otherwise provided by law, specified in an effective legal instrument, or permitted by us, you may not transfer, gift or allow others to inherit membership benefits under your device ID in any manner.
You may not gift, lend, lease, transfer or sell a device ID, or otherwise permit or share it for others’ use. If we discover or have reasonable grounds to believe that the user is not the original holder of the device ID, for security purposes we have the right to take measures including but not limited to immediately suspending or terminating services to that device ID and blocking it, and we reserve the right to pursue liability for breach and other legal liabilities.
You shall use Paji Camera in a compliant manner. The following conduct violates the rules of use:
Engaging in conduct that violates laws, regulations or policies, undermines public order and good morals, or harms public interests.
Leasing, lending, copying, modifying, linking, reproducing, compiling, publishing, creating a mirror site of Paji Camera or related information therein without authorization, or using Paji Camera to develop derivative products, works, services, plug-ins, add-ons, compatibility or interconnection related thereto.
Logging in to or using Paji Camera through third-party compatible software or systems not developed, authorized or recognized by us or our affiliates, or using plug-ins or add-ons for Paji Camera that are not developed, authorized or certified by us or our affiliates.
Removing copyright information or content from Paji Camera or copies thereof, or modifying, deleting or circumventing any technical measures in the app product that we set for intellectual property protection.
Leasing, lending or sublicensing Paji Camera to any third party without our written consent, or using multiple licensed versions simultaneously or transferring them separately after obtaining a license to use an upgraded version of Paji Camera.
Copying, decompiling or modifying Paji Camera or any part thereof, or creating derivative works; copying, modifying, hooking or running, or creating derivative works from any data released into a terminal during operation of Paji Camera or any interaction data between the terminal and server during operation of Paji Camera, including access to Paji Camera and related systems through plug-ins, add-ons or unauthorized third-party tools/services.
Engaging in any conduct that endangers information network security, including damaging or disrupting Paji Camera in any manner, causing it to fail to operate or become overloaded, or interfering with third parties’ use of Paji Camera; entering others’ computer systems without permission and deleting, modifying or adding stored information; intentionally disseminating malicious programs or viruses, or other conduct that damages or interferes with normal network information services.
Using Paji Camera to publish, transmit, disseminate or store content that infringes others’ intellectual property rights, trade secrets or other lawful rights, or engaging in fraud, misappropriation of others’ accounts or funds, or other illegal or criminal activities.
Modifying or forging instructions, data or data packets during operation of Paji Camera to add, delete or change its functions or operating effects, and/or disseminating or operating software with the foregoing purposes to the public via information networks.
Using Paji Camera in any other illegal manner, for any illegal purpose, or in any manner inconsistent with this Agreement.
When using Paji Camera, you may not shoot the following content through Paji Camera:
Content opposing the basic principles established by the Constitution;
Content endangering national security, disclosing state secrets, subverting state power, or undermining national unity;
Content damaging national honor or interests;
Content distorting, defaming, desecrating or denying the deeds and spirit of heroes and martyrs, or infringing their names, portraits, reputation or honor by insult, defamation or other means;
Content promoting terrorism or extremism, or inciting terrorist or extremist activities;
Content inciting ethnic hatred or discrimination or undermining ethnic unity;
Content undermining national religious policies or promoting cults or feudal superstition;
Content spreading rumors or disrupting economic or social order;
Content spreading obscenity, pornography, gambling, violence, murder, terror or instigating crime;
Content insulting or defaming others or infringing others’ reputation, privacy or other lawful rights and interests;
Other content prohibited by laws and administrative regulations;
Content using exaggerated titles that are seriously inconsistent with the content;
Content hyping gossip, scandals or misconduct;
Improper comments on natural disasters, major accidents or other calamities;
Content containing sexual innuendo or sexual provocation likely to cause sexual association;
Content showing bloody, frightening or cruel scenes causing physical or mental discomfort;
Content inciting group discrimination or regional discrimination;
Content promoting vulgar, low-grade or kitsch content;
Content that may induce minors to imitate unsafe behavior, violate social morality, or develop bad habits;
Other content that has an adverse impact on the online ecosystem.
We have the right, based on our sole independent judgment, to restrict use of your device ID or suspend services if we believe that circumstances may endanger national security or public security or infringe our or others’ lawful rights and interests, and will subsequently notify you by email, in-app message, SMS or telephone.
You understand and agree that we will determine whether you are suspected of violating the above rules of use and, based on the determination, suspend or terminate your use license or take restrictive measures against your device ID as appropriate.
For information posted by you when using Paji Camera that is suspected of being illegal, infringing others’ lawful rights, or violating this Agreement, we will directly delete it.
If your violation of the above rules causes damage to any third party, you shall independently bear legal liability in your own name and hold us harmless from losses or increased expenses arising therefrom.
If you violate relevant laws or this Agreement and cause us to suffer any losses, or cause any third-party claim or administrative penalty against us, you shall compensate us for the losses and/or expenses incurred thereby, including reasonable attorneys’ fees and investigation and evidence collection costs.
If we take restrictive or suspension measures against you due to abnormal activity of your device ID, you may apply to lift the restriction or restore services. You shall truthfully submit relevant supporting materials and other information or documents required by us so that we may verify your identity. You understand and agree that your appeal request may not necessarily be approved, and we have the right to determine at our discretion whether to approve it.
Paji Camera provides paid online services. For such services, Paji Camera will give you clear prompts before use; only after you confirm that you are willing to pay the relevant fees may you use the relevant paid online services. If you refuse to pay the relevant fees, Paji Camera has the right not to provide such paid online services.
After purchasing membership services, you may enjoy member-exclusive filters, beauty effects and other exclusive functions. Detailed membership benefits shall be subject to those stated on the relevant product interface.
You understand and agree that membership services are for your personal use only, and you may not provide the device ID to any third party by lending, leasing, selling, transferring or any other means.
You understand and agree that member-exclusive filters, beauty effects and other exclusive functions provided in the membership services are for your personal use only and may not be used for commercial purposes.
After you confirm the purchase of membership, relevant fees will be charged to your account (iOS users will be charged through their Apple account; Android users through Alipay or WeChat account; Huawei users through Huawei in-app payment; and Google users through Google Play).
If you select “continuous monthly subscription, continuous quarterly subscription, or continuous annual subscription”, the subscription will automatically renew and fees will be charged on the corresponding day of the next cycle. If you need to cancel automatic payment, please do so at least 24 hours before the automatic payment period; otherwise, the subscription will remain valid. You may suspend or terminate the service through the following methods:
For Apple in-app payment auto-renewal users: open “Settings” on your iPhone --> tap your avatar to enter “Apple ID” --> tap “Subscriptions” and cancel the corresponding auto-renewal.
For Alipay auto-renewal users: open “Alipay” --> “Me” --> “Settings” --> “Payment Settings” --> “Password-free Payment/Auto-deduction”, select “Paji Camera Membership Service Auto-renewal Service”, and turn off the service.
For WeChat auto-renewal users: open “WeChat” --> tap “Me” --> “Services” --> “Wallet” --> “Payment Settings” --> “Auto-Renewal” --> find and tap the corresponding Paji Camera auto-renewal service --> tap “Turn Off Deduction Service” and confirm.
For HarmonyOS in-app payment auto-renewal users: open “Settings” --> tap “Huawei ID” --> “Payments and Billing” --> “Subscriptions” --> select “Paji Camera” and tap “Cancel Subscription”.
For Google Play payment: open Google Play Store --> tap the avatar in the upper-right corner --> Payments & subscriptions --> Subscriptions --> find the corresponding app --> Cancel subscription.
Paji Camera may use or include software or services provided by third parties (“such services”), which are provided for your convenience and have been lawfully authorized by the relevant third parties.
Because third parties are the providers of their software or services, when you use such services you shall separately enter into service agreements with such third parties, pay corresponding fees and bear possible risks. You understand that we have no right to grant you any right to use such services under this Agreement and make no warranties of any kind for such services. We cannot provide customer support for such services; if you need support, you may contact the third party directly. Any dispute arising from your use of such services may be resolved directly with the third party.
You understand that Paji Camera currently uses or includes such services only, and we cannot guarantee that Paji Camera will permanently use or include such services, nor that it will not use or include software or services of the same or different type from that third party or other third-party software or services in the future. Once we use or include the foregoing software or services in Paji Camera, the corresponding software or services shall also be governed by this clause.
You agree that if the third party confirms that you have violated its agreement regarding the use of such services and stops providing such services to you and requests us to handle the matter, because cessation of such services may affect your continued use of Paji Camera, we may suspend or terminate your use license or take other restrictive measures against you that we may take.
We attach great importance to protecting your data, and protection of user data is one of our basic principles. We have formulated the Paji Camera Privacy Policy to make important disclosures regarding collection, use, sharing, storage and protection of your information and other matters closely related to your interests. We recommend that you read the Paji Camera Privacy Policy in full to better protect your personal information. The Paji Camera Privacy Policy constitutes an integral part of this Agreement and applies together with this Agreement to your use of Paji Camera services.
We will make best efforts to use various security technologies and procedures to establish a sound management system to protect your data against unauthorized access, use or disclosure.
Text, effects, stickers, templates and other materials and functions built into Paji Camera or to be built in the future for beautifying your images and videos (collectively, “Materials”), as well as other text, pictures, audio, video, files, information, website architecture, interface designs, data and documents, are protected by law and are subject to corresponding intellectual property rights owned by us or other right holders, including but not limited to copyrights, trademarks, patents or other exclusive rights.
We grant you a non-transferable and non-exclusive right of use. Any Materials and other camera information content downloaded or used through Paji Camera are limited to your personal entertainment, study, research or appreciation and may not be used for any commercial purpose without our written consent. You shall not, and shall not permit any third party to, copy, modify, reverse assemble or otherwise decipher or attempt to decipher source code, sell or transfer the “Software”, sublicense the “Software”, or otherwise transfer any rights in the “Software”. You agree not to modify the “Software” in any way or use modified “Software”.
Icons, buttons, service names and other marks included in or provided by Paji Camera are trademarks or commercial identifiers legally owned by us, our affiliates or partners in China and other countries, except for rights enjoyed by relevant right holders pursuant to law. Without the prior written consent of us, our affiliates or relevant right holders, you may not copy, imitate or use any of the foregoing trademarks or commercial identifiers, or engage in any other conduct that may cause confusion among the relevant public and/or consumers.
Without the prior written consent of us, our affiliates or relevant right holders, you may not use, modify, reverse engineer, decompile or disassemble, reproduce, link to, copy, publicly transmit, disseminate, distribute or publicly publish any program or content of Paji Camera, or embed any program or content of Paji Camera (or any part thereof) into other software or services, or compile or create a mirror site of any program or content of Paji Camera (or any part thereof).
You undertake that you have intellectual property rights in, or have obtained lawful authorization for, any form of content uploaded or transmitted during your use of Paji Camera services, including but not limited to images.
Respect for intellectual property is your obligation. Without the prior written consent of us, our affiliates or relevant right holders, you may not implement, use, transfer or license any third party to implement, use or transfer the above intellectual property for any profit-making or non-profit purpose. In case of violation, you shall bear all liabilities.
If your device ID falls under the following circumstances, we have the right to terminate services to you: your conduct seriously violates the service use rules in this Agreement, laws and regulations, or requirements of competent state authorities.
You understand and agree that after we terminate services to you, we will process your personal information in accordance with the Paji Camera Privacy Policy.
You understand and agree that we may conduct the following commercial activities in products or services provided by us: sending you commercial advertisements or other relevant commercial information about us or third parties through Paji Camera, mobile SMS, email or other lawful means.
We especially remind you that if push information you receive concerns a third party rather than us, after we perform relevant obligations for publishing advertising information in accordance with law, you shall independently judge the authenticity of the content and be responsible for your judgment. Unless expressly provided by law, we shall not be liable for any losses or damages you suffer due to the content of such information.
You understand and agree that, based on adjustments to our business strategy, we may change service content or interrupt, suspend or terminate services.
When we undergo merger, division, acquisition or asset transfer, we may transfer relevant assets under this Agreement to a third party; we may also, after notifying you unilaterally, transfer some or all services and corresponding rights and obligations under this Agreement to a third party for operation or performance. The specific transferee shall be subject to our notice.
If any of the following circumstances occurs, we have the right to interrupt or terminate services to you without notice:
You are required by laws and regulations to submit true information, but the personal information you provide is untrue;
You violate relevant laws and regulations or this Agreement;
As required by judicial authorities or competent departments in accordance with laws and regulations;
For security reasons or other necessary circumstances.
You are responsible for backing up data stored in Paji Camera. If your service is terminated, we have the right to permanently delete your data from the server, unless otherwise provided by laws and regulations. After services are suspended or terminated, we are not obligated to provide or return data to you.
We have the right to terminate your use of Paji Camera if any of the following circumstances occurs:
You violate relevant laws and regulations, have an illegal purpose, or use the arrangements under this Agreement to infringe others’ lawful rights and interests;
You infringe the rights and interests of us and/or other third parties by fabricating facts, forging evidence, publishing false information, colluding with third parties or other means;
You seriously violate this Agreement or other rules published on the Paji Camera platform, and we have the right to terminate your use of Paji Camera in accordance with this Agreement.
We have the right to terminate all services of the Paji Camera platform after reasonable prior notice based on our commercial arrangements. This Agreement shall terminate on the date when all services of the Paji Camera platform are terminated through statutory procedures and methods.
Termination of this Agreement shall not affect the rights and obligations of the parties accrued before termination, including but not limited to the non-breaching party’s right to pursue liability for breach against the breaching party under this Agreement.
After termination of this Agreement, for transaction orders generated during the term of this Agreement, you may negotiate with the transaction counterparty on whether to continue performance and submit to the Paji Camera platform the written agreement signed and/or sealed by both parties. Otherwise, we may notify the transaction counterparty and decide whether to close such transaction orders according to the counterparty’s wishes; if the counterparty requires continued performance, you shall continue to perform this Agreement and the transaction orders and bear any losses or increased expenses arising therefrom.
You agree to protect and safeguard the interests of Paji Camera, Paji Camera partners and other users. Any of the following circumstances shall be deemed a breach by you:
Violation of relevant laws and regulations when using Paji Camera platform services;
Violation of this Agreement or its supplemental agreements.
If information you publish on our products constitutes a breach, we may immediately delete, block or otherwise handle such information in accordance with the relevant rules.
If your conduct causes losses to us or our affiliates (including our direct economic losses, goodwill losses and indirect economic losses such as external compensation, attorneys’ fees and litigation costs), you shall compensate us or our affiliates for all such losses. If your conduct causes a third party to assert claims against us or our affiliates, we or our affiliates may recover all losses from you after assuming monetary payment or other obligations to the third party.
Unless expressly provided by laws and regulations, we will use best efforts to ensure that Paji Camera and the technologies and information involved are secure, valid, accurate and reliable; however, due to limitations of existing technology, you understand that we cannot guarantee this.
Given the special nature of online services, we have the right to change, suspend or terminate part or all of the services according to Paji Camera’s overall operation or relevant operating norms and rules.
To provide you with better services, we have the right to inspect, maintain and upgrade the platform or related equipment providing Paji Camera on a regular or irregular basis. Such circumstances may cause interruption or suspension of relevant services for a reasonable period, and we shall not be liable for losses you suffer thereby, unless otherwise mandatorily provided by law.
Our services are provided on an “as is” basis according to existing technology and conditions. We will use best efforts to provide services to you and ensure continuity and security of services; however, we cannot guarantee that the services provided are free from defects, nor can we foresee and prevent at all times service interruption, data loss and other losses and risks caused by technical and other risks. Even if the services provided by us have defects, if such defects were unavoidable at the then-current industry technical level, they shall not be deemed our breach, and unless otherwise mandatorily provided by law, we shall not be liable for losses you suffer thereby.
During use of Paji Camera, force majeure and other risk factors may cause interruption of Paji Camera. Force majeure refers to objective events that cannot be foreseen, overcome or avoided and that have a material impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, and social events such as wars, unrest and state actions (including acts by legislative, administrative and judicial authorities and organizations authorized by national laws, regulations or policies to manage public affairs). In the above circumstances, we will endeavor to cooperate with relevant units at the earliest time and strive for timely restoration; however, we shall be exempt from liability for losses caused to you thereby to the extent permitted by law.
To the extent permitted by law, we shall not be liable for service interruption or obstruction caused by the following circumstances:
Damage caused by computer viruses, Trojans or other malicious programs, or hacker attacks;
Failures of your or our computer software, systems, hardware or communication lines;
Improper operation by you;
Your use of Paji Camera through means not authorized by us;
Obsolete program versions, aging equipment, and/or compatibility issues;
Other circumstances beyond our control or reasonable foreseeability.
Our right to handle illegal or non-compliant content under this Agreement does not constitute an obligation or commitment of Benqu Technology, and we cannot guarantee timely discovery of illegal acts or corresponding handling.
The validity, interpretation, amendment, performance and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China. Where no relevant legal provisions exist, general international commercial practices and/or industry practices shall be referenced.
Any dispute arising out of or in connection with this Agreement may be resolved through friendly consultation between you and us. If consultation fails, both you and we agree that the dispute shall be resolved by litigation before the people’s court with jurisdiction over the domicile of Shanghai Benqu Technology Co., Ltd.
When using Paji Camera services, you shall provide us with true and valid contact information (including your telephone number). If such contact information changes, you are obliged to update it in a timely manner and keep it available.
Paji Camera may send notices to you through the above contact information. Written notices sent electronically, including but not limited to SMS to your provided telephone number, email to your provided email address, and official platform notices, shall be deemed served upon successful sending; written notices in paper form shall be deemed served on the fifth natural day after mailing to the provided contact address.
If Paji Camera fails to contact you according to the last information provided by you, if you fail to timely provide information as required by Paji Camera, or if the information you provide is obviously untrue or is verified as invalid by administrative or judicial authorities, you shall bear all losses and adverse consequences caused thereby to yourself, others and Paji Camera. We may send you inquiries or rectification notices and require re-authentication until we suspend or terminate part or all of Paji Camera services to you. Except as expressly provided by law, Paji Camera shall not be liable for this.
Your use of Paji Camera or services shall be deemed that you have read and accepted this Agreement. We have the right to modify the terms of this Agreement when necessary. You may review the latest version of the terms on the relevant service page. If you continue to use our software or services after the terms are changed, you shall be deemed to have accepted the changed Agreement.
If any provision of this Agreement is partially invalid or unenforceable for any reason, it shall not affect the validity of the other provisions or any part thereof, which shall remain binding on both parties, and you and we shall continue to perform in good faith.
The headings of all clauses of this Agreement are for convenience of reading only and have no substantive meaning, and shall not be used as a basis for interpreting the meaning of this Agreement.
The intellectual property clauses, governing law and jurisdiction clauses, and other clauses that by their nature should survive under this Agreement shall not become invalid due to termination of this Agreement.
